ExactWork Website Terms of Use
These terms apply to your use of www.exactwork.ca (the "site"). By using the site, you agree to them. If you don't agree, please don't use the site.
1. Who we are
The site is operated by Rafael Bueno, a sole proprietor carrying on business as ExactWork, Calgary, Alberta ("ExactWork", "we", "us").
- Mailing address: 7070E Farrell Rd SE, Suite 332, Calgary, AB T2H 0T2, Canada
- Email: hello@exactwork.ca
ExactWork is a founder-led consultancy. We work on marketing systems and automation, CRM and customer data, and practical AI.
2. Using the site
You may browse the site and use its content for your own information and internal business purposes. Please don't:
- break the law while using the site, or use it to send spam or malicious code;
- try to gain unauthorized access to the site, its forms or its hosting, or interfere with its security or spam protection;
- scrape or copy the site in bulk by automated means, including to build datasets or train AI models, without our written permission;
- pretend to be someone else when you contact us.
We may change, suspend or remove any part of the site at any time.
3. Information only, not professional advice
Our articles, guides, checklists, examples, tools and any other free material (together, "content"):
- are general technical and operational information. They are not professional, legal, tax, privacy or compliance advice for your situation;
- may refer to laws such as Canada's Anti-Spam Legislation, but they are not legal advice. Get advice from a qualified lawyer about your own obligations;
- describe platforms and features that change often, so content may be out of date or incomplete. Examples are illustrative and do not describe real client work unless we say so.
Check anything important with the platform's official documentation, and test it, before you rely on it.
4. No client relationship until we sign
Using the site, reading content, sending a form or email, or having an introductory call does not make you a client. It does not create a consulting, advisory or confidential relationship.
An engagement starts only when we both sign a statement of work (SOW) or services agreement. That signed document then governs the work, including scope, fees, confidentiality, intellectual property and liability. If it conflicts with these terms, the signed document wins.
5. Contact form and messages
- Please don't send confidential or sensitive information through the site or a first email. That includes client lists, customer data, credentials, API keys, trade secrets or other people's personal information. Wait until we have signed a non-disclosure agreement (NDA) or services agreement that covers it.
- Until then, we are not under a confidentiality obligation for what you send. We will still handle your personal information as described in our Privacy Policy.
- If you send us ideas or feedback, we may use them without any obligation to you. This does not apply to confidential information you share under a signed NDA or agreement.
- We may not reply to every message, and a reply is not an offer to provide services.
6. Our content and your licence
The site and its content, including text, guides, graphics, the ExactWork name and logo, and the layout, belong to Rafael Bueno (ExactWork) or our licensors, and are protected by copyright and other laws.
We give you a limited, non-exclusive, revocable, non-transferable licence to:
- view, download and print content for your own information or your organization's internal use;
- quote short excerpts, or share links, with credit to ExactWork and a link to the source page.
You may not republish, sell, or offer as your own any substantial part of the content, remove copyright or attribution notices, or use the ExactWork name or logo in a way that suggests we endorse you, without our written permission.
7. Third-party trademarks and platforms
Oracle, Oracle Responsys, Oracle Eloqua, HubSpot, Salesforce, Marketo, Google and other product and company names on the site are trademarks of their respective owners. We use them only to describe the platforms we work with.
ExactWork is an independent consultancy. Unless we expressly say so, we are not affiliated with, sponsored by or endorsed by any of these companies. Our references to their products are not endorsements by them.
8. Links to other sites
The site links to third-party sites and documentation, for example vendor documentation, government guidance and social media. We don't control them and are not responsible for their content, availability or privacy practices. Their own terms apply.
9. No warranty
We try to keep the site accurate and available. However, the site and all content are provided "as is" and "as available", without any promise that they are accurate, complete, current, error-free, secure or fit for a particular purpose. To the extent the law allows, we disclaim all implied warranties and conditions.
10. Limitation of liability
To the extent the law allows:
- (a) we are not liable for any indirect, incidental, special or consequential loss arising from your use of the site or content, or from relying on it. This includes lost profits, revenue or data, and business interruption;
- (b) our total liability for all claims relating to the site or content is limited to CAD $100.
What this section does not limit:
- liability for fraud, wilful misconduct or gross negligence;
- liability for personal injury caused by our negligence;
- any right or remedy that cannot be limited or excluded by law, including rights an individual consumer has under Alberta's Consumer Protection Act or similar laws where they live.
This section covers only the free site and content. Paid work is governed by its signed SOW or services agreement (section 4).
11. Privacy
Our Privacy Policy explains how we collect, use and protect personal information through the site, including the contact form, Google reCAPTCHA, analytics and cookies.
12. Changes to these terms
We may update these terms from time to time. We will post the new version on this page and change the effective date above. Changes apply from that date to later use of the site. They do not apply to any signed SOW or services agreement, which can be changed only as that document allows.
13. Governing law and courts
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. You and we agree that the courts of Alberta in Calgary will deal with any dispute about the site or these terms.
This does not take away any right an individual consumer has to bring a claim where they live or under laws that cannot be overridden. If any part of these terms is unenforceable, the rest still applies.
